The late actress Vanessa Marquez’s mother and the City of South Pasadena recently agreed to settle an unlawful death lawsuit for $ 450,000.
Earlier this week, a federal judge approved a $ 450,000 settlement to end an unlawful death lawsuit filed by Vanessa Marquez’s mother, Delia McElfresh. Marquez was a well-known actress for her role in the popular drama “ER”. Tragically, she was fatally shot and killed by police in 2018 when they arrived at her South Pasadena home for a wellness check-up, according to court documents.

The lawsuit was filed in federal court in Los Angeles last August. In named the city of South Pasadena, its former police chief and other officials as defendants. When filing the lawsuit, McElfresh spoke out against law enforcement allegations that the 49-year-old actress was shot while swinging what officials believed was a gun.
Theresa Highsmith, the City of South Pasadena attorney, commented on the recent settlement, saying the parties involved had approved the settlement “which will largely come from the city’s litigation risk pool.” Diana Mahmud, the mayor of South Pasadena, also interfered with the settlement and said, “Every loss of life is tragic.”
What happened? How did such a tragic incident come about? Well, according to the lawsuit, Marquez had a history of seizures. Her mother argued in the lawsuit that she was “shot dead when she did not face officers, when the officers were a safe distance from her and when there was no imminent threat of serious injury or death to the officers or others”. The Los Angeles District Attorney’s Office pushed back against the allegations, however, and concluded that the “officers were acting in self-defense.” It added that “Marquez pointed at what looked like a gun.” Upon further investigation, it was found that “the weapon was a BB-type weapon that resembled a semi-automatic pistol”.
As he commented on the incident, Sgt. Joe Mendoza of the Los Angeles County Sheriff’s Department said, “She (Marquez) had some problems, an eating disorder … When she (officer) arrived, she had a seizure.”
In addition, the Sheriff’s Department found that “a county mental hospital with officers from South Pasadena was on site and spoke to Marquez for over an hour and a half to provide medical care.” Unfortunately, “she then armed herself with a pistol and pointed it at the officers. At that point, there was a shooting involving an officer.” It was only later discovered that the gun was actually a BB gun.
In addition to her role on “ER”, Marquez appeared in several guest roles on popular TV series such as “Seinfeld”, “Melrose Place” and “Wiseguy”. She also appeared in “Stand and Deliver,” a 1988 film.
